Welcome to the Moses Music Studios Website (the "Site"). The Site is is designed to help provide you with a more immersive and personalized music entertainment experience. The Site is your digital guide to the magic of exciting benefits and features that the Moses Music Studios has to offer. By accessing or using the Moses Music Studios website, online services, mobile and other applications and social networking, you agree to be bound by these Terms of Use and any additional terms and conditions that are referenced below or otherwise may apply to specific areas of the Site.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

You represent that you are legally able to accept these Terms of Use, and affirm that you are of legal age to form a binding contract, or have obtained parental or guardian consent to do so. If you do not agree to these Terms of Use, you may not use our services.

NOTE: THIS TERMS OF -- USE CONTAINS A BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISION IN THE "BINDING ARBITRATION" SECTION BELOW THAT AFFECTS YOUR RIGHTS UNDER THIS TERMS OF -- USE AND WITH RESPECT TO ANY "DISPUTE" (AS DEFINED BELOW) BETWEEN YOU AND US OR OUR AFFILIATES. YOU HAVE A RIGHT TO OPT OUT OF THE BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS AS FURTHER DESCRIBED IN THE "BINDING ARBITRATION" SECTION BELOW.

Cancellations & Refunds

Client may cancel the agreement at any time before the event:

  • In the instance of a client cancellation, the client must notify Moses Music Studios, via phone and email, as far in advance of the event date as possible. There is no refund on the deposit. Then Client will pay the remaining balance to Vendor on the same day that the cancellation is made, unless a rescheduling of the event is made. *see Rescheduling

Vendor may cancel the agreement at any time before the event:

  • In the instance of a Vendor cancellation, the Vendor must notify the Client immediately, via phone and email, and then return the deposit payment in full to Client within (7) days after the cancellation. Moses Music Studios will use commercially reasonable efforts to help find a suitable replacement vendor for the client’s event. However, we do not guarantee that a replacement will be made.
  • If the Client’s guests participate in dangerous and/or criminal behavior (ie: drugs, contraband, fighting, etc.) the Vendor will cancel his performance immediately and the Client will pay Vendor the remaining balance (via cash, PayPal, Venmo, or Zelle) at the time of the Event.

Damages & Liability

  • If Client damages any of Vendor’s equipment, Client will pay for such damages within 7 days after the event.
  • If Vendor damages any of Client’s belongings or property, Vendor will pay for such damages within 7 days after the event.

Music Breaks

  • Vendor will take a 15 min. break at the top of each hour, during which time he will play a preassembled music playlist from Apple Music (unless Client has requested that Vendor not use a sound system or unless Client directs otherwise).
  • The Playlist will be complementary to the Live music selection already being performed at the Event (unless Client directs otherwise).

Overtime

  • If the Client requests that the Vendor’s performance go into overtime, the Client will pay Vendor $100.00 per every hour of Vendor’s performance that extends beyond the Event’s contractual end time.
  • If the Client ends the event, prior to a full hour of requested overtime, Client will still pay for a full hour.
  • In the unlikely event that the Vendor experiences a delay as a result of unforeseen Traffic (ie: accidents, road work, etc.), Vendor will inform Client while en route to the Event, and be willing to make up the lost performance time – with Client’s permission – by adding it to the end of the Event, in overtime, at no additional charge to Client. If Client does not agree to adding time to the end of the performance, Vendor will offer Client a discount of $100 off the remaining balance.

Prohibited Items and Activities

Payment Types

  • Displaying, handling or use of any firearms, ammunition, weapons, illegal drugs, fireworks, marijuana, cigarettes.  Legal smoking implements (pipes, cigars, vapes etc.) are permitted but must be kept a minimum of (50) feet from Vendor
  • Engaging in any unsafe act that may impede Vendor’s performance.
  • Touching or moving Vendor’s equipment without his permission.

Parental Advisory

  • All Entertainment services are “Family-friendly” and do not contain profanities or explicit drug, violence, or sexual references that may be unsuitable material for guests. However, the client can request an entertainment program that is more age-appropriate for the crowd.

Payments

Payment Types

  • Unless otherwise stated, all fees are quoted in U.S. Dollars. The Client can make payments with:  PayPal, Venmo, Zelle. Payments can be made by check for the deposit, but not for the remaining balance. Payments can be made in cash for the Remaining Balance, at which time Vendor will discreetly count the money received – in front of Client – to make certain the amount is correct. Credit Card payments are not accepted.

Deposits

  • The deposit (50% of the payment due) MUST be made at the time of the booking to secure the reservation of Vendor’s performance (unless an alternative option has been agreed upon by both Client and Vendor at the time of the booking).

Remaining Balance

  • The Client will pay Vendor the remaining balance at the event (unless an alternative option has been agreed upon by both Client and Vendor at the time of the booking).

Payment Processing

  • The Client shall be responsible for all fees associated with the sending, receiving and processing of payments and associated bank fees.

Disputes

  • In the event of a dispute, the Client agrees to contact Moses Music Studios directly with all inquiries regarding such purchased services. For avoidance of doubt, any disputes directly with Moses Music Studios shall be handled in accordance with the terms and conditions of these Terms of Use.

Referred Vendors

  • Vendors that are referred by Moses Music Studios are solely responsible for performing any booked services to their clients and the obligations of their agreements. Moses Music Studios has no obligation to handle or facilitate the handling of payments, scheduling or disputes between a referred Vendor and their Client, and is in no way liable for the referred Vendor or the Vendor’s agreements and obligations.

Rescheduling

  • If Client requests a rescheduling of the time and/or date of the Event, Vendor will work with Client to reschedule the Event for a different day/time that is agreeable to both Client and Vendor.
  • If a rescheduling of the event cannot be made, the Client can keep the event on calendar for the original date or the event will be cancelled. *See Cancellations and Refunds.
  • If the client reschedules the event for a new date, the new date must be scheduled within 6 months after the original date. Client will pay the remaining balance to Vendor on the same day that the cancellation is made.  There is no refund on the deposit.  Client will then have a credit for the event that can be used by the Client or can be made transferable to a third party provided by the Client.  Vendor cannot reschedule the new date without the agreement of the Client.

Stage Requirements

  • Vendor will not perform on any soiled, unbalanced or potentially unsafe surface/stage area (ie: dirt, water, slope, etc.)
  • Vendor’s surface/stage dimensions need to be 7′ x 7′ (at minimum).  A smaller stage area might be acceptable if agreeable to Vendor.
  • If outdoors, stage (performance area) must have some source of shade so that direct sunlight does not damage Vendor’s equipment.

Travel Conditions

  • If the Vendor experiences a delay as a result of unforeseen Traffic (ie: accidents, road work, etc.), Vendor will inform the Client while en route to the Event, and be willing to make up the lost performance time, by adding it to the end of the Event, at no additional cost to Client. *see Overtime

Weather Conditions

  • If air temperature is below 60°F, a “heat lamp” must be provided (or Vendor must be relocated to a warmer area).
  • If air temperature is above 95 °F, then “shade” or “AC” must be provided to Vendor.
  • If there is precipitation (drizzle, rain, fog, snow, hail, etc.) – and Vendor is outdoors – then Vendor must be relocated to a “dry/warm” area.
  • If there are strong winds (25+ MPH) – and Vendor is outdoors – Vendor must be relocated to a “safer” area.
